Terms of Service
These Terms of Service (“Terms”) govern your use of the websites, mobile applications, watch apps, digital spreadsheets, and templates produced by The Meier Co. (“we,” “us,” “our”). By downloading, installing, opening, or otherwise using any of our products, you agree to these Terms. If you do not agree, do not install or use our products.
What’s in this document
1. Eligibility
You must be old enough to enter into a binding contract in your jurisdiction (in most US states, 18). Our products are not directed at children under 13.
Senior Assistant is intended for adults. Where a caregiver sets up Senior Assistant on behalf of a senior (the person using the device day-to-day), the caregiver is the agreeing party to these Terms and is responsible for ensuring they have the authority and consent to do so.
2. Our products
The Meier Co produces, among other things:
- Mobile applications on Google Play (Android) and the Apple App Store (iOS): currently All Aboard (cruise companion), OhFark (Farkle dice game), Dirty30 (Farkle-variant elimination game), and Senior Assistant (Android home-screen launcher for caregivers).
- Wear OS smartwatch companion apps paired with their phone-app counterparts where applicable.
- Spreadsheets and digital templates distributed through Etsy.
Each product is provided under these Terms, plus any product-specific terms noted below.
3. In-app purchases (one-time)
Some of our mobile apps offer one-time in-app purchases — for example, “Remove Ads” or a “Deluxe upgrade” — that unlock additional features or remove advertisements. These are processed by Google Play (Android) or the Apple App Store (iOS). We never see your payment method, billing address, Apple ID, or Google account credentials.
One-time purchases apply to the Google or Apple account that bought them. Restoring a one-time purchase on a new device requires signing in with the same account.
4. Subscriptions & auto-renewal
Senior Assistant is offered as a subscription with two billing cadences, plus an optional one-time “Lifetime” purchase:
- Monthly — billed every month at the price displayed in Google Play.
- Annual — billed every year at the price displayed in Google Play.
- Lifetime — a one-time purchase that unlocks the app permanently for the buying Google account. Lifetime is not a subscription and does not renew.
Auto-renewal. Monthly and Annual subscriptions automatically renew at the end of each billing period at the then-current price displayed in Google Play. Renewal continues until you cancel. Google Play notifies you in advance of any price change and offers you the chance to accept or cancel.
How to cancel. You can cancel at any time through Google Play:
- Open the Play Store app.
- Tap your profile picture (top-right corner).
- Tap Payments and subscriptions → Subscriptions.
- Tap Senior Assistant.
- Tap Cancel subscription.
Cancellation takes effect at the end of the current billing period. You retain access until then. Cancellation does not refund the current period’s charge.
We cannot cancel for you. Subscription management — including cancellation, plan changes, and pause requests — must be done through Google Play on the account that purchased the subscription. This is a Google policy that applies to all Play Store subscriptions.
5. Free trials
Senior Assistant’s Monthly and Annual plans include a 14-day free trial. The Lifetime purchase does not include a trial.
During the trial:
- You enter payment information at signup as required by Google Play, but no charge is made.
- You have full access to all Senior Assistant features.
- The trial runs for 14 calendar days from signup.
How the trial converts. Unless you cancel before the 14-day trial ends, the trial automatically converts to a paid subscription on day 15 at the plan price displayed at signup. You will be charged through Google Play at that time and on each subsequent renewal date.
How to cancel during the trial. Follow the same cancellation steps as section 4 above. As long as you cancel before day 14 ends, you will not be charged.
Heads up: Uninstalling the app does not cancel the trial or subscription — you must cancel through Google Play. Uninstall and forgot? Reinstall and check your subscription status in the app, or open Play Store → Payments and subscriptions → Subscriptions.
6. Refunds & cancellation
Refunds for purchases made through Google Play (subscriptions, Lifetime, one-time upgrades, Remove Ads, Deluxe) are governed by Google Play’s refund policy. We do not process refunds directly for Google Play purchases.
- Within 48 hours of purchase: You may request a refund through Play Store → profile → Payments and subscriptions → Budget and order history → tap the order → Request a refund.
- After 48 hours: You may still request directly with us (see Contact below) and we will work with Google to honor reasonable refund requests, particularly for trial charges that were unintentional.
Refunds for purchases made through the Apple App Store are governed by Apple’s refund policy and go through Apple, not us.
Refunds for Etsy template purchases follow Etsy’s policy and are described in the next section.
Cancellation of a subscription does not entitle you to a refund of the current billing period. Access continues until the end of that period.
7. Spreadsheets & templates (Etsy)
Spreadsheets, templates, and other digital files we sell on Etsy are licensed for your personal use upon download. Because these are digital downloads delivered immediately, all sales are final once the files have been accessed or downloaded.
If a file is corrupted, unreadable, or substantially different from what was described, message us through Etsy and we will work to make it right.
Legal-adjacent templates (such as project-management charters, meeting scripts, or any document that resembles a contract or policy) are general-purpose starting points only. They are not a substitute for professional legal advice. Use of any legal-adjacent template is at your own risk and you are responsible for adapting it to your specific situation.
8. Senior Assistant — additional terms
Senior Assistant is an Android home-screen launcher that simplifies the look and behavior of an Android phone — particularly for an older adult set up by a caregiver. The following additional terms apply to its use.
Not a medical device, not for clinical care
Senior Assistant is an accessibility launcher. It changes how the Android home screen looks and behaves. It is not a medical device. It is not designed, tested, certified, or intended to diagnose, treat, monitor, prevent, or cure any medical condition — including memory changes, dementia, Alzheimer’s disease, or any other cognitive, physical, mental-health, or chronic condition. It is not a fall detector. It does not monitor vital signs. It does not provide medical alerts. It does not replace caregivers, medical professionals, in-home care, monitoring services, or emergency services.
Any description of Senior Assistant on our website, in marketing material, or in the app store as “designed for memory changes,” “peace of mind,” or similar refers to the simplicity of the user interface — not to clinical care, medical claims, or any form of monitoring.
The SOS button
The red SOS button on the Senior Assistant home screen places a one-tap phone call to a contact you (the caregiver) designate in advance. You acknowledge and agree that:
- SOS is not a connection to 911, to emergency services, to a monitoring service, or to any third party. It calls the number you put in the Emergency Contact field.
- The contact you designate may be unreachable, may not answer, may not be in a position to help, or may not respond promptly.
- SOS does not transmit your location with the call. It does not auto-call 911 if no one answers. It is not a fall detector.
- SOS does not work if the device has no cellular service, no carrier coverage, no battery, or is powered off.
- You — the caregiver — are responsible for designating an appropriate contact and confirming with that contact that they understand the role.
- If anyone using a Senior Assistant device requires immediate emergency assistance, they should dial 911 (US) or the local emergency number directly. SOS is not a substitute.
Caregiver setup and responsibility
Senior Assistant is typically configured by a caregiver on a device that will be used by another person (“the senior”). When you set up Senior Assistant for someone else, you are responsible for:
- Having the legal or familial authority to manage that person’s device.
- Obtaining informed consent from the senior, to the extent possible given their circumstances, before configuring features that share their location or read their data (contacts, calendar, etc.).
- Choosing which apps, contacts, and notifications appear on the home screen.
- Setting and safeguarding the caregiver PIN.
- Designating an appropriate Emergency Contact for the SOS button.
- Periodically reviewing settings and the System Status panel for configuration drift.
- Agreeing to these Terms on behalf of the senior where the senior is unable to do so themselves.
Master PIN — recovery, not security
Senior Assistant includes a built-in master PIN (1397) that bypasses a forgotten caregiver PIN. This is a recovery mechanism for caregivers, not a security boundary. Anyone with physical access to the device and knowledge of the master PIN can enter caregiver mode. The senior’s actual device-level security (Android lock-screen PIN, fingerprint, Google account password, Find My Device) is the meaningful security layer.
Third-party services
Senior Assistant integrates with several non-Meier-Co services. Use of those services is governed by their own terms and privacy policies:
- Google Play Billing — for subscriptions and Lifetime.
- Google Family Group + Google Maps Location Sharing — if you choose to set them up using our Help guide.
- Open-Meteo (open-meteo.com) — for weather forecasts.
- The device’s installed apps — Senior Assistant launches whichever Email, Messages, Browser, etc., the caregiver designates.
9. Disclaimer of warranties
Our products are provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, express or implied. To the maximum extent permitted by applicable law, we disclaim all warranties including merchantability, fitness for a particular purpose, non-infringement, and any warranty arising out of course of dealing or trade usage.
We do not warrant that our products will be uninterrupted, error-free, secure against unauthorized access, free of bugs, or compatible with every device. We do not warrant any specific outcome from the use of our products.
Alarms, reminders, countdowns, and any time-sensitive feature (including the All Aboard departure alarm and Senior Assistant medication reminders) are visual and audible reminders only — you are responsible for taking the underlying action (boarding the ship, taking the medication, attending the appointment, etc.). Senior Assistant reminders are passive and may not sound an audible alarm; you are responsible for using a separate alarm if you need one.
10. Limitation of liability
To the maximum extent permitted by applicable law, in no event will The Meier Co or its agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or related to your use of (or inability to use) our products — even if we have been advised of the possibility of such damages.
Without limiting the foregoing, The Meier Co is not liable for:
- Missed reminders, alarms, countdowns, or notifications, including but not limited to medication reminders, calendar reminders, appointment reminders, or cruise departure alarms.
- Failure of the SOS button to result in help being rendered, whether due to the designated contact’s non-response, lack of carrier signal, dead battery, device power-off, or any other reason.
- Any medical, health, safety, or care outcome related to the use of Senior Assistant.
- Loss of data stored on your device, including favorites, app folders, reminders, and PIN.
- Actions taken or not taken by third-party apps that our products launch (Email, Messages, Browser, Maps, etc.).
- Charges by your carrier, including data, SMS, or international charges.
If, despite the above, we are found liable for any claim related to our products, our total liability to you for all damages, losses, and causes of action will not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) $50 USD.
Some jurisdictions do not allow the exclusion or limitation of certain damages. To the extent such limitations cannot be enforced under your local law, our liability is limited to the smallest amount permitted by law.
11. Governing law
These Terms are governed by the laws of the State of Virginia, USA, without regard to its conflict-of-laws principles. Any disputes arising out of or related to these Terms or our products will be brought in the state or federal courts located in Virginia, and you and we consent to the jurisdiction of those courts.
If any provision of these Terms is held unenforceable, the remaining provisions remain in full effect.
12. Changes to these Terms
We may update these Terms from time to time. When we do, we will update the effective date at the top of this page. Material changes — for example, changes to subscription pricing terms or refund policy — will be communicated via the app or in the next reasonable opportunity (e.g., on launch, before a renewal). Continued use of our products after a change indicates acceptance of the updated Terms. If you do not agree, your remedy is to stop using the affected product and (for subscriptions) cancel through Google Play.
